1. Definitions
The following terms carry specific meanings throughout this document:
- "Agreement" — these Terms and Conditions, together with any service engagement letter or written scope of work agreed between Pathiya Law and the Client.
- "We / Us / Our" — Pathiya Law, a family legal services practice registered and operating in Bangkok, Thailand.
- "Client / You / Your" — the individual or individuals who engage Pathiya Law for a legal matter or who use this website.
- "Services" — the family legal services offered by Pathiya Law, including Separation Options Review, Parenting and Support Arrangements, and Mediation and Agreement Drafting, as further described on our website and in any engagement letter.
- "Website" — the Pathiya Law website accessible at pathiyalaw.live and any associated pages.
- "Content" — all text, materials, documents, and outputs produced by Pathiya Law in connection with the Services.
2. Acceptance of Terms
By using our website or engaging our Services, you indicate that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of these terms, please do not use our website or engage our Services.
To engage Pathiya Law, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement under Thai law. If you are engaging on behalf of another person (for example, as a legal guardian), you represent that you have the authority to do so.
An engagement is formed when we confirm in writing — by email or letter — that we have accepted your instruction. Use of the website does not of itself create a client relationship.
3. Service Description
Pathiya Law provides family legal services to individuals and families in Thailand. Our current service offerings are as follows:
Separation Options Review — ฿1,480
A considered review of available separation options, explained clearly so that families can understand the paths available and make decisions in their own time.
Parenting and Support Arrangements — ฿2,760
Patient assistance arranging parenting responsibilities and financial support, with the wellbeing of children kept at the centre throughout.
Mediation and Agreement Drafting — ฿4,130
Considerate mediation support alongside plain drafting of agreements, so that all parties understand the terms and feel comfortable with the outcome.
We operate from 88 Rama IV Road, Khlong Toei, Bangkok 10110, Thailand, and serve clients primarily within Thailand. Services are provided in Thai and English.
The scope of each engagement will be agreed with you before work begins. Any variation to the agreed scope will be confirmed in writing before additional work proceeds.
4. Client Responsibilities
To allow us to assist you effectively, we ask that you:
- Provide accurate, complete, and timely information relevant to your matter.
- Notify us promptly if your circumstances change in a way that may affect your matter.
- Communicate with us in a respectful and constructive manner.
- Review documents and correspondence we provide within any timeframe agreed, or within a reasonable period.
- Make payments in accordance with the agreed fee schedule.
- Not use our website or services for any purpose that is unlawful or harmful to others.
You agree not to use our website to upload or transmit malicious code, to attempt to gain unauthorised access to our systems, or to interfere with the website's proper functioning.
5. Intellectual Property
All content on this website — including text, layout, design, and graphic elements — is the property of Pathiya Law or its licensors and is protected under applicable intellectual property law. You may not reproduce, adapt, or redistribute website content without our prior written permission.
Documents and written materials prepared by Pathiya Law in connection with your matter are provided for your personal use in relation to that matter. They may not be shared beyond the parties to your matter, published, or used for any other purpose without our written consent.
You retain ownership of documents and information you provide to us. By sharing them, you grant us a limited right to use that material solely for the purpose of delivering the Services to you.
6. Payment Terms
Fees are stated in Thai Baht (฿) and are outlined in the engagement letter or scope of work provided to you before work begins. Payment methods accepted include bank transfer and such other methods as may be agreed.
Unless otherwise agreed in writing, payment is due within 7 days of our invoice date. Where a service involves multiple stages, a payment schedule will be agreed at the outset.
Cancellations: If you wish to cancel an engagement before work has commenced, please notify us as soon as possible. Where work has already begun, fees for work completed to the point of cancellation remain payable. We will provide a clear account of work done.
Fees quoted represent our professional time and preparation; they do not include court fees, government charges, or third-party disbursements, which will be communicated to you separately should they arise.
7. Service-Specific Terms
The following terms apply to the delivery of our legal services:
- Timelines: Family matters vary in complexity and pace. While we will work with reasonable diligence, we cannot commit to specific completion dates unless agreed in writing. Timelines depend partly on the cooperation of all parties involved.
- Scope: Each service covers the matters described in the service description and any agreed engagement letter. Matters that arise outside the agreed scope will be discussed with you before additional work is undertaken.
- Changes in circumstances: If your situation changes materially during an engagement, please let us know. We will discuss with you whether and how the scope or fee should be adjusted.
- Third parties: We act for you alone. Where the interests of other parties are involved (for example, in mediation), we will make clear to all parties the basis on which we are acting.
Our services are advisory and drafting in nature. We do not provide court representation as part of the services described on this website, unless separately agreed in writing.
8. Confidentiality
We treat all information shared with us in connection with your matter as confidential. We will not disclose your personal or family information to third parties except as necessary to carry out the Services, as required by law, or with your prior consent.
We are bound by professional obligations of confidentiality that continue after the conclusion of an engagement. Our Privacy Policy, available at privacy-policy.html, describes how personal data is handled.
9. Disclaimers
Our Services are provided with reasonable skill and care, but we cannot represent that any particular outcome will be achieved in your family matter. Legal outcomes depend on many factors, including the circumstances of all parties, negotiation, and — where court involvement arises — judicial discretion.
Information on our website is provided for general guidance only and does not constitute legal advice. Specific legal advice is provided only within the context of a confirmed client engagement.
The website is provided on an "as available" basis. We do not warrant that it will be uninterrupted or free of error, and we are not responsible for any loss arising from reliance on information contained on the website.
10. Limitation of Liability
To the extent permitted by Thai law, our total liability to you for any claim arising from or connected with the Services shall not exceed the fees paid by you for the specific service to which the claim relates.
We shall not be liable for any indirect, consequential, or special loss, including loss of opportunity, even if we have been advised of the possibility of such loss.
Nothing in these terms limits our liability for fraud, willful misconduct, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold harmless Pathiya Law, its staff, and its representatives from any claim, loss, or expense arising from your breach of this Agreement, your misuse of our website, or any inaccurate or misleading information you have provided to us in connection with a matter.
12. Termination
Either party may bring an engagement to a close by giving reasonable written notice. We will take care to hand over any materials needed for continuity and will invoice for work completed to date.
We reserve the right to cease acting in circumstances where continuing would be professionally inappropriate, where instructions are not forthcoming, or where fees remain unpaid after reasonable notice.
Provisions of this Agreement that by their nature should survive termination — including confidentiality, intellectual property rights, payment obligations for work done, and limitation of liability — will continue to apply after an engagement ends.
13. Dispute Resolution
This Agreement is governed by the laws of Thailand. Any dispute arising from this Agreement shall be subject to the jurisdiction of the Thai courts.
Before commencing formal proceedings, we ask that you raise any concern with us in writing. We are committed to addressing concerns thoughtfully and, where possible, resolving matters informally. Most concerns can be resolved through open communication.
Where a dispute cannot be resolved informally, the parties may agree to refer the matter to a mutually acceptable mediator before pursuing court proceedings.
14. General Provisions
- Entire Agreement: This Agreement, together with any engagement letter, constitutes the entire agreement between the parties regarding its subject matter and supersedes prior discussions.
- Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce a provision does not constitute a waiver of that provision in future.
- Assignment: You may not assign your rights under this Agreement without our written consent. We may assign our obligations in connection with a business transfer, provided that the standard of service to you is not adversely affected.
- Notices: Formal notices under this Agreement should be sent by email or post to the contact details below. Email is considered received on the next business day following sending.
15. Changes to These Terms
We may update these Terms from time to time. When we do, the revised version will be posted on this page with an updated effective date. We encourage you to review these terms periodically.
For ongoing engagements, any material changes will be communicated to you directly. Continued use of our website following a change constitutes acceptance of the revised terms.
